RULES OF USE OF ONLINE STORE lencas.lt

1. General provisions

1.1. These rules of use of the online store (hereinafter - the Rules) establish the rights and obligations of the Buyer and JSC Lencas, company’s code 182918244, Sausinės str. 2, Sausinės vlg., LT-54312 Kaunas district (hereinafter referred to as the Seller), the procedure of acquisition, payment, delivery, return of goods, liability of the parties and other provisions when the Buyer acquires goods in the online store.

1.2. The Seller has the right to unilaterally change, amend or supplement the Rules at any time, taking into account the requirements established by legal acts. Amendments to the Rules enters into force from the moment of their publication in the Store. If the Buyer continues to use the Store after the publication of the amended Rules, it means that the Buyer unconditionally agrees to all amendments to the Rules.

1.3. The online store lencas.lt sells only in the territory of the Republic of Lithuania.

2. Personal data protection

2.1. To order goods in the online store and / or use other Store services, the Buyer must register on this website, providing correct and complete all mandatory data. If the Buyer is a legal entity, he must indicate the legal entity code and the VAT payer code (if any).

2.2. The Buyer is fully responsible for the accuracy of the data provided in the registration form and assumes full responsibility for all consequences that have occurred or may occur to the Buyer and / or third parties due to the incorrectness of the provided data.

2.3. The Buyer understands and agrees that any actions taken after logging in to the online store using the Buyer's login details will be considered by the Seller as actions taken by the Buyer; therefore the Buyer undertakes to keep the login details confidential and not disclose them to third parties and also take all possible security measures to prevent them from being used by third parties.

2.4. The Seller undertakes not to disclose the Buyer's personal data to third parties except in cases when it is necessary for the proper execution of the Buyer's order. In all other cases, the procedure established by the legal acts of the Republic of Lithuania shall apply.

2.5. The Buyer agrees that the Seller shall manage and process his data provided during registration for the purposes provided in these Rules.

2.6. By confirming these rules, the Buyer agrees that the information messages necessary for the execution of the order of goods will be sent to the specified e-mail address and telephone number.

3. The purchase-sale agreement conclusion

3.1. A purchase and sale agreement is concluded for each order. The Agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer forms a shopping cart in his/her name in the online store, indicates the delivery address, chooses the payment method, and reads these Rules, clicks the "Buy" or "Order" button and pays for the goods.

3.2. The sale and purchase agreement is valid until the full fulfillment of obligations under this agreement.

3.3. The order is executed after payment. Immediately after payment, the customer will receive an order confirmation email, which he/she specified when making the payment.

4. Buyer's rights and obligations

4.1. The Buyer has the right to purchase goods in the online Store lencas.lt in accordance with the requirements established in these Rules and legal acts of the Republic of Lithuania.

4.2. The Buyer has the right to withdraw from the purchase and sale agreement concluded with the online store lencas.lt by notifying the Seller in writing no later than within 14 working days from the day of delivery of the goods to the Buyer.

4.3. The Buyer must accept the ordered goods and pay the goods' price and delivery.

5. Seller's rights and obligations

5.1. In the event of significant circumstances, the Seller has the right to temporarily or permanently terminate the operation of the e-shop without any additional notice.

5.2. The Seller may cancel the order without informing the Buyer in advance if the Buyer, having chosen payment via electronic banking or payment by bank transfer, does not pay for the goods within 3 (three) business days.

5.3. If the Buyer tries to damage the stability and security of the online store or otherwise violates his/her obligations, the Seller may restrict or suspend the Buyer's access to the online store without prior notice. In exceptional cases, the Buyer's registration may be canceled.

5.4. The Seller has the right to place links to other websites in the online store but is not responsible for the information published or activities performed on them.

5.5. The Seller has other rights provided for in the Conditions and legal acts of the Republic of Lithuania.

5.6. The Seller undertakes to provide the Buyer with the opportunity to use the services provided by the online store under the conditions outlined in these Rules and the online store.

5.7. The Seller undertakes to organize the delivery of the goods ordered by the Buyer to the address specified by the Buyer.

5.8. Unable to deliver the ordered goods to the Buyer due to important circumstances, the Seller undertakes to offer the Buyer a similar or as similar as possible product. If the Buyer does not agree with this offer, the Seller returns the money paid by the Buyer within 5 working days.

6. Price of goods and procedure of their payment

6.1. In the online Store and in the formed order, the prices of the goods are indicated in euros with VAT.

6.2. Next to each specific Item is its description. If the information provided to the Buyer is insufficient, he/she must contact the Seller for additional information. By ordering the product, the Buyer confirms that the information about the product provided in the Store is complete and clear to him.

6.3. The Seller has the right to change the range of goods in the Store, their descriptions, prices, delivery conditions, and other information in the Store at any time without informing the Buyer.

6.4. The delivery fee is not included in the product's price unless explicitly stated otherwise.

6.5. The Buyer can pay for the goods using electronic banking through the electronic banking system he/she uses or make a payment by card.

6.6. If the Buyer do not pay for the goods within 3 (three) working days, JSC Lencas has the right to cancel the order without prior notice.

6.7. The Buyer sees and can print the order form - a prepayment invoice.

7. Delivery of goods

7.1. The Seller delivers the goods throughout Lithuania except for the Curonian Spit.

7.2. The Buyer undertakes to indicate the exact place of delivery of the goods at the time of ordering.

7.3. The Buyer undertakes to accept the goods himself. In case he/she cannot accept the goods himself and the goods have been delivered to the specified address and on the basis of other data provided by the Buyer, the Buyer has no right to make claims to the Seller regarding the delivery of the goods to the wrong entity.

7.4. The goods are delivered no later than within 4 working days after the day of receipt of payment.

7.5. The goods are delivered by the Seller or his authorized transport company.

7.6. The delivery price does not include the unloading price of the goods when the weight of the consignment exceeds 30 kg. The Buyer pays for this service.

7.7. During the delivery of the goods, the Buyer must, together with the representative of the Seller or his authorized transport company, check the condition of the shipment, the quantity, quality and range of the goods. Suppose the Buyer or another person receiving the goods signs the consignment note without comments, in that case, it is considered that the consignment has been delivered intact and subsequent claims for damage to the packaging of the consignment will not be accepted.

7.8. If the Buyer refuses to accept the ordered goods or delivery of the goods is impossible due to the Buyer specifying an incorrect delivery address when ordering the goods, the Buyer must pay a fine of 100 EUR and reimburse the Seller for all losses incurred by the Seller due to improper performance or non-performance.

7.9. The Seller shall not be liable for the non-delivery or late delivery of the ordered goods to the Buyer, if this was due to the fault of third parties or due to circumstances beyond the Seller's control and reasonable foresight and could not prevent these circumstances or their consequences.

8. Warranty

8.1. For all goods sold in the shop the manufacturer's quality warranty is given.

8.2. The validity period of the goods sold in the Store is unlimited unless otherwise stated next to the goods.

9. Return of goods

9.1. The return of goods takes place in accordance with the 2001 June 29 order of the Minister of Economy of the Republic of Lithuania No. 217 "On the Approval of the Rules for the Return and Exchange of Items". The Buyer may return the goods to the Seller at the address (S.Kerbedžio str. 21, Panevėžys LT-35114) via the courier who delivered them or by post no later than within 14 working days from the date of delivery to the Buyer, informing the Seller in writing (info@Lencas.lt). In this case, the Buyer shall be refunded the full price paid for the returned goods, but the delivery costs of the goods shall not be refunded or reimbursed. The Buyer shall pay the costs of returning the goods to the Seller. For goods returned in accordance with the conditions provided for in this clause, the money paid by the Buyer shall be returned to the Buyer's account no later than within 14 working days from the date of delivery of the returned goods to the Seller.

9.2. Returned goods must be intact seals (if any), in the original packaging of the goods and the consignment, must not be used or have lost their commercial appearance. The Buyer is responsible for the complete assembly and packaging of the goods. If the goods are not fully assembled, used and/or damaged and/or have lost their appearance, are untidy and/or improperly packaged, the Seller has the right not to accept the returned goods and not to return the money paid by the Buyer.

9.3. The Buyer may not return such goods, the possibilities of return of which are not established by the legal acts of the Republic of Lithuania.

10. Exchange of information

10.1. The Seller sends all notifications to the e-mail address provided in the Buyer's registration form.

10.2. The Buyer shall send all notices and questions to the address specified in the "Contacts" section of the Seller's online store.

11. Final provisions

11.1. The Rules of online store parduotuve.Lencas.lt have been drawn up in accordance with the legal acts of the Republic of Lithuania; therefore, the law of the Republic of Lithuania applies to the relations arising on their basis.

11.2. All disputes arising out of or in connection with the purchase and sale agreement between the Buyer and the Seller shall be settled by negotiation. If no agreement is reached, disagreements shall be resolved in accordance with the procedure established by the legal acts of the Republic of Lithuania.
