Lencas, JSC (hereinafter - the Company) is the controller of personal data processed in it, which ensures that personal data in the Company is processed in accordance with the personal data protection requirements applicable to data controllers. This Privacy Policy applies in cases when you provide us with your personal data through the website lencas.lt (hereinafter - the Website).

This Privacy Policy describes how we collect, use, and process your data when you use our Website. By using the Website, you consent to the collection and use of information in accordance with this Privacy Policy.

Please note that this Privacy Policy applies only to this Site. This Site may contain links to other sites that we do not use or control. The links made from this Site do not imply endorsement or review of such third-party sites.

The data protection policy has been developed in accordance with the following legal acts:

(a) 2016 April 27 Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (General Data Protection Regulation) (hereinafter BDAR);

(b) the Law on the Legal Protection of Persons of the Republic of Lithuania (hereinafter - ADTAĮ);

(c) the Law on Electronic Communications of the Republic of Lithuania (hereinafter - ERĮ).

When processing personal data, the Company follows the requirements established in BDAR, ADTAĮ, ERĮ, as well as in other legal acts regulating the processing and protection of personal data.

3 What information do we collect about you?

We collect and use the following information:

3.1 Personal data

When you use our Website, we may collect certain personal information about you (hereinafter -Personal Data), i.e., when you voluntarily provide such information, such as when you use certain of our services, contact us, and so on. When we collect Personal Data, we provide a link to this Privacy Policy.

3.2 Usage data

We may also collect information that your browser provides when you visit the Site or when you access the Site via a mobile device (hereinafter -Usage Data).

This may include information related to your IP (Internet Protocol) address, browser and device type, information about which websites you have visited before, and other identifiers associated with your device.

If you provide Personal Data for a particular purpose, we may use that data based on the purpose for which such data was provided. For example, if you contact us by email, we use the Personal Information you provide to answer your question or resolve the issue. If you provide Personal Data in order to use certain services on the Site, we will use your Personal Data to give you access to such services and to monitor your use of such services. We and our group companies (hereinafter -  Related companies) may also use your Personal Data and other non-personally identifiable information collected through the Site to help us improve the content and functionality of the Site, better understand our users and improve our services. We and our Affiliates may use this information to communicate with you regarding the provision of the Services.

5 How is your personal data processed for direct marketing purposes?

Direct marketing is an activity the purpose of which is to offer goods or services to individuals by post, telephone or other direct means and / or to seek their opinion on the goods or services offered (Article 2 part 1 of the ADTAĮ).

We inform that if you consent to the processing of Personal Data for direct marketing purposes, the Company's processing of Personal Data includes offers to you, news about the services provided, information about ongoing events, promotions or other information, as well as your opinion about the services by your provided email.

By agreeing to the processing of Personal Data for the purposes of direct marketing, you also agree that the Personal Data will be transferred to third parties - Company partners who will process your Personal Data for the purposes of direct marketing. 6 Are you required to provide us with Personal Data?

Please note that in order to create an account on the Website or use certain features of the Website, you must provide us with the above Personal Data (see Section IV of this Policy).

You can choose to consent to the processing of Personal Data for direct marketing purposes, but if you wish to receive direct marketing communications, you must agree to provide the specified Personal Data.

7 Where do we get your data from (what is the origin of the data)?

We receive personal data directly from you, i. e. when you register (create an account) on the Website and / or use other services of the Website.

8 Who do we provide your personal data to?

The information you provide to us, including Personal Data, may be transferred to computers outside the jurisdiction of your state, where data protection laws may differ from the laws of your jurisdiction. If you are outside the Republic of Lithuania, please note that we process Personal Data in Lithuania. By voluntarily providing us with Personal Data, you consent to its use in accordance with this Privacy Policy. We inform that we will not share your Personal Data with others without your permission unless we determine that such disclosure is reasonably necessary to (a) comply with the law; (b) prevent fraud or abuse; or d) protect our property rights.

The Company does not transfer your personal data to third countries or international organizations, i.e. outside the European Union or the European Economic Area, unless required to do so by law or court, or for one of the purposes specified in this Policy.

9 Your rights as a data subject

By submitting your Personal Data through our Website and in accordance with BDAR, you have the following rights:

● the right to receive information on data processing;

● the right of access to your personal data, including the right to a copy of personal data;

● the right to request the rectification of your personal data if they are inaccurate;

● the right to request the deletion of your personal data ("right to be forgotten");

● the right to request restrictions on the processing of your personal data;

● the right to data portability;

● the right to object to the processing of data.

 

We inform that if you do not agree with the Company's decision made regarding your application related to the implementation of your rights as a data subject, you have the right to file a complaint to the State Data Protection Inspectorate (more information https://vdai.lrv.lt/ ).

In order to implement the above-mentioned rights, you must submit a request to us in writing and in a manner that allows us to identify you, i. e. confirming your identity. Applications for the implementation of BDAR rights, in the absence of the possibility to identify the applicant, are not considered by the Company.

You also have the right to withdraw your consent (if any) to the processing of your personal data for direct marketing purposes at any time. You can withdraw your consent at any time by submitting a free-form request by email to info@lencas.lt. Withdrawal of consent shall not affect the lawfulness of processing based on consent prior to its withdrawal.

All notices relating to the processing of personal data should be submitted:

Your requests related to the implementation of data subjects' rights are processed for a maximum of 1 (one) month. Depending on the complexity of the application and the number of applications received, this period may be extended by the Company for 2 (two) months.

Requirements for a request when submitted in writing:

(a) the application must be legible;

(b) the application must be signed;

(c) the application must include your name, place of residence, contact information;

(d) the request must specify the right you wish to use and, where applicable, the arguments or documents supporting the request;

(e) If a representative makes the request on your behalf, the request must include not only the above information but also the name, address and contact details of your representative.

Ways to verify your identity:

(a) When submitting the application upon direct arrival at the Company's office: by submitting an identity document to the Company's employee;

(b) In the case of an application by post: the application must be accompanied by a notarized copy of the identity document or a copy of this document certified in accordance with another procedure prescribed by law;

(c) By submitting an application by email. Requests submitted in this way must be signed with a qualified electronic signature or formed by electronic means that ensure the integrity and irreplaceability of the text (unless you revoke your consent to the processing of personal data in accordance with this Policy).

Signing a request with a qualified electronic signature allows the Company to correctly identify you and ensure that the information you request or information about the execution of your requested actions (refusal to execute) is disclosed only to the person to whom it is addressed, i. e. to you.

Scanned copies of signed applications or complaints submitted by email without signing them with a qualified electronic signature do not comply with the requirements established by legal acts. Such an application may be an obstacle to the acceptance of your application, so if you do not have a qualified electronic signature, you should submit the application by post or go directly to the Company's office.

When submitting an application through a representative, the application must be accompanied by a document confirming the representation or a copy thereof, approved in accordance with the procedure established by legal acts.

10 Changes

The Company reserves the right to change or supplement the terms of this Privacy Policy. The Company notifies about the changes on the Website.

We encourage you to review this Privacy Policy for changes periodically. This Privacy Policy was last updated on the date above. If you continue to use the Site after any changes or revisions to this Privacy Policy, you will be deemed to have agreed to the terms of such revised Privacy Policy.
